Terms of Use for the Archive "Forced Labor 1939-1945"

The interview archive "Forced Labor 1939-1945" is part of the Oral-History.Digital platform. In order to access the contents of the archive, you must first register on Oral-History.Digital and accept the terms of use. You can then apply for activation of the archive "Forced Labor 1939-1945. Memories and History". After successful verification by the project team, you can access the contents of the archive with your Oral-History.Digital access data (e-mail address and password). These supplementary terms of use apply to the archive "Forced Labor 1939-1945, Memories and History".

1. General information 

The interview archive "Forced Labor 1939-1945. Memories and History" (hereinafter: Archive) is provided by Freie Universität Berlin (hereinafter: FU Berlin) on behalf of the Foundation "Remembrance, Responsibility and Future" (hereinafter: Foundation) via the platform Oral-History.Digital on the Internet. The archive contains biographical interviews with former Nazi forced laborers.ontains life story interviews with former forced laborers from the time of the Second World War.

2. Use of the Archive

The archive is accessible only for educational, teaching and research purposes, in particular for pupils, students, academics, research institutes and other public institutions. In addition, the archive may be made available to journalists, remembrance projects and private individuals for personal research purposes if a legitimate interest exists.Use for advertising purposes, election campaigns or the like is prohibited.Any misuse of the archive material to defame the victims of National Socialism, to deny National Socialist crimes, to incite hatred or to propagate anti-Semitic, racist or nationalist content will be reported to the police.

3. Property Rights

The archive and its contents are protected by copyright, data protection law and the personal rights of the interviewed witnesses, the interviewers and other persons involved in the creation of the application, as well as the Foundation and Freie Universität Berlin. When using the archive, users must always ensure that the personal rights of the interviewed witnesses are respected and that their data worthy of protection is not disseminated or their interests are not impaired.

4. Application for Use of the Archive

Use of he archive requires an application in electronic form. After successful evaluation of the application, the applicant receives the required login in data electronically (user ID and password). This data must be treated confidentially and is not to be disclosed to third parties. In case of misuse, the Operator is authorized to withdraw the permission of use and, if necessary, to initiate further legal action.To use the archive, you must be registered in Oral-History.Digital and submit an application for access to the archive. Once the project team has reviewed your request, you will be able to access the archive using your Oral-History.Digital login (email address and password).The request for activation will only be granted if all mandatory fields have been filled in correctly and the full name has been entered when registering in Oral-History.Digital.When requesting access to the archive, the research interest must correspond to the intended use and be specified.

5. Permitted Use and Citation

Users have access to the audio or video interviews, the transcripts of the interviews, translations and short biographies as well as photos. Quotations are permitted in independent works in accordance with and within the framework of Section 51 of the Copyright Act. The source must be cited with every quotation. Please observe the citation guidelines given for each interview.  The anonymization of the interviewee's surname must also be observed in the text if the name refers solely to the interview from the archive and the full name does not appear from other sources.

6. Editing the Archive Materials

Editing of the archive material is not permitted under these Terms of Use. Editing includes altering the content of the archive material (e.g. cutting, shortening, etc.) or copying the archive material. Editing of archival material requires special permission. You can apply for permission using this application form.

7. Liability

As a user, you agree to use the content solely in compliance with these terms of use. You confirm that you will take all necessary precautions to prevent misuse by third parties. In case of misuse, you will immediately inform the FU Berlin and support it in the judicial or extrajudicial assertion of its rights, provide the necessary information, documents, records, etc., and indemnify it against claims by third parties.

8. Exclusion of Liability

Claims for damages against FU Berlin are excluded, regardless of legal grounds, unless FU Berlin, its legal representatives, or employees have acted with intent or gross negligence. This limitation of liability does not apply to claims for damages resulting from injury to life, limb, or health or the assumption of a guarantee of quality or fraudulent concealment of defects. FU Berlin is not liable for statements made in the interviews.

9. Data Protection

The Privacy Policy  of the Oral-History.Digital platform applies to the archive. We collect personal information when you apply to use Oral-History.Digital or activate your account in the archive. We will retain this information only as long as necessary for the use of Oral-History.Digital and the archive and will not disclose it to third parties without your express consent. 

By accepting these Terms of Use, you authorize the FU Berlin to process, store, evaluate, and utilize the data received regarding the archive in compliance with data protection laws. More details about data protection are available in the Privacy Policy

The FU Berlin commits to treating this information as per data protection regulations. Matomo, an open-source software, is used by the FU Berlin to analyze and statistically assess archive usage. The information gathered regarding the archive's usage is solely stored on FU Berlin servers utilizing pseudonymous user profiles. Your acceptance of these terms of use constitutes permission for this proceeding.

10. Applicable law and final provisions

German law shall apply. The place of fulfillment and exclusive jurisdiction is Berlin, where legally permissible. The FU Berlin reserves the right to revise these terms of use for the future.
